Give by Devise or Bequest

Language In General

A devise and or bequest (“gift”) to the Support Group for whatever purpose should be made payable to “Dana Point 5th Marine Regiment Support Group”, as this is the legal name of the public benefit, non-profit, tax-exempt corporation.  The gift may then provide that it shall be used for general purposes or a specified purpose.  
The below sample gift language may assist you as you consider creating a gift for the Support Group, but we always recommend that our donors consult their own legal counsel and/or tax advisors regarding specific language for their wills and or trusts.

Unrestricted Gifts

Unrestricted gift:

I devise and or bequeath to Dana Point 5th Marine Regiment Support Group, a California public benefit, non-profit, tax-exempt corporation located at Dana Point, California, [written dollar amount, or percentage of the estate, or description of property], as an unrestricted gift.

Unrequested gift by general endowment:

I devise and or bequeath to Dana Point 5th Marine Regiment Support Group, a California public benefit, non-profit, tax-exempt corporation located at Dana Point, California, [written dollar amount, or percentage of the estate, or description of property], which shall be added to the general, unrestricted permanent endowment funds of Dana Point 5th Marine Regiment Support Group, so that the income derived therefrom may be used for general support purposes.

Restricted Gifts

Gift for a specific purpose:

I devise and or bequeath to Dana Point 5th Marine Regiment Support Group, a California public benefit, non-profit, tax-exempt corporation located at Dana Point, California (“Support Group”), [written dollar amount, or percentage of the estate, or description of property], the principal and any income of which is to be used at the discretion of the Trustees of the Support Group for [specific purpose], or in the event that such use shall in the judgment of such Trustees be or become impracticable, then for such purpose(s) as such Trustees shall at their discretion determine.

Residuary Gift

Unrestricted residuary gift:

I devise and or bequeath to Dana Point 5th Marine Regiment Support Group, a California public benefit, non-profit, tax-exempt corporation located at Dana Point, California (“Support Group”), the rest and residue [or a written percentage amount of the rest and residue] of my estate, to be applied to the general purposes of the Support Group.
